On April 9, 2025, the ABC Board adopted this Notice of Eighth Emergency Rulemaking by a vote of five (5) to zero (0). This action was necessary to allow the emergency rulemaking to remain in effect while the previously adopted Final Rulemaking is pending publication in the D.C. Register.
This eighth emergency rulemaking increases the cap on the number of permitted Retailer Class CT or DT (tavern) licenses to sixteen (16), maintains the moratorium on Retailer Class CN or DN (nightclub) licenses, and renews the Adams Morgan Moratorium Zone (“AMMZ”) for three (3) years.
These rules maintain the status quo, preventing an overconcentration of licensed establishments and helping reduce the severity of problems associated with overconcentration, such as overcrowding on public space, noise, and anti-social behavior related to alcohol consumption. The emergency rules are scheduled to remain in effect for one hundred twenty (120) days, expiring on August 7, 2025, unless superseded by the final rulemaking.
