Notice of Rulemaking on Prorated License Fees

On March 4, 2026, the ABC Board, voted 4 to 0, to adopt this Notice of Proposed Rulemaking, which was edited for clarity and added a new Subsection to Subtitle C, MEDICAL MARIJUANA, of Title 22, HEALTH, of the District of Columbia Municipal Regulations: 

  • 1301.5
    The initial annual license fee for a medical cannabis facility license issued at any time after the beginning of the license year shall be prorated based on the number of days remaining in the license year; provided that the prorated amount shall be rounded to the nearest dollar.
     
  • 1301.6
    If a medical cannabis facility license was issued, before [the effective date of this rulemaking], for a period of less than twelve (12) months for the first license year, and the licensee paid the entire annual license fee for the first license year, the license holder shall have its next annual license fee reduced to the amount that the licensee would have paid for its first license year pursuant to § 1301.5, if § 1301.5 had been in effect when the first license year fee had been imposed.

The Board intends to adopt these proposed rules as final rules, in not less than thirty (30) days after the date of publication of this notice in the District of Columbia Register, and upon completion of the thirty (30) business day Council review period.
